A Profile of Advocate Nkosinathi Malgas

Advocate Nkosinathi Malgas is a distinguished Human Rights advocate, specializing in South Africa’s Land Reform Programme. He holds a Bachelor of Arts degree from Wits University, as well as LLB degrees from both Pretoria and Unisa Universities. Additionally, he completed an Advanced Labour Law program at Wits University and obtained an MPhil from Nelson Mandela University.

Throughout his illustrious career, Advocate Malgas has held various senior positions within the post-apartheid administration. He has showcased his expertise in representing clients facing unfair labour dismissals across numerous government departments. A notable achievement includes successfully representing ten employees unfairly dismissed by Discovery Company for violations of the company’s social media policy.

In addition to his labor law endeavors, Advocate Malgas has been a steadfast advocate for clients seeking compensation from the Road Accident Fund (RAF) . Furthermore, he has provided legal representation to numerous land claimants who submitted claims to the Commission on Restitution of Land Rights under the Restitution of Land Rights Act No. 22 of 1994 before December 1998. His advocacy efforts have extended to the Land Claims Court in Randburg, Johannesburg, within the Gauteng Province.

Outside of his legal practice, Advocate Malgas serves as the Executive Director of the Advocate Malgas Foundation, a non-profit organization dedicated to community empowerment and social justice initiatives.

The Foundation's Goals

The Foundation’s main goal is to protect and promote Human Rights in South Africa’s democratic system. As outlined in the Constitution Act 108 of 1996, we aim to make Human Rights practical realities in the daily lives of all citizens. Additionally, South Africa’s commitment to the United Nations Declaration of Human Rights obliges us to take concrete actions.

As Nelson Mandela stated in his address to the Joint Session of the House of Congress in Washington DC on June 26, 1990, denying Human Rights dehumanizes individuals. Poverty and deprivation strip people of their humanity.

Aligned with these principles, the Foundation works on multiple fronts to advance Human Rights. Firstly, this includes conducting research to identify key issues and trends. Moreover, we advocate for policy changes to address systemic challenges. Furthermore, we provide assistance and offer free legal services to those in need. Ultimately, our goal is to ensure that Human Rights are more than just ideas but tangible improvements in the lives of everyone.

International Travels

The Executive Director of the Foundation has extensively traveled the world both for  work-related tasks and lesiure. His international travel started when he was part of the liberation struggle which brought constitutional democracy in South Africa. His commitments to human rights were influence and inspired by the sufferings during the apartheid regime which caused him at the age of 19 years to go into exile.
