DONATION REQUEST: KAMGADZENI COMMUNITY LAND CLAIM
DONATION TOWARDS RESTORATIVE SOCIAL JUSTICE ON KAMGADZENI COMMUNITY LAND CLAIM: CASE NUMBER: LCC49/2022/LCC49/2022 LAND CLAIMS COURT IN JOHANNESBURG.
- This community was historically dispossessed and forcefully removed from their ancestral land in terms of the Land Act of June 1912 on the below-mentioned farms: Killyman 187 JT; Sabaani View 186 JT; Bergvliet 174 JT; Gradysy 510 JT; Hebron 190 JT; Ligfontein 189 JT; Duminy 184 JT; Langverwatch 181 JT; Hector 183 JT and Mambitam 21 JT, [Deeds Research Print and Map].
- The community lodged its community land claim in terms of section 10(1) of the Restitution of Land Rights Act No. 22 of 1994 prior to December 31, 1998, with the Commission on Restitution of Land Rights.
- The Community land claim was gazetted in terms of section 11(1) of the Restitution of Land Rights Act No. 22 of 1994 in August 2007 as valid and legitimate.
- In terms of section 24(1) of the Restitution of Land Rights Act No. 22 of 1994, the Commission on Restitution of Land Rights is required and/or enjoined to support community land claimants to pursue restorative social justice.
- It has been almost thirty years of constitutional democratic dispensation, and the land has not been restored to them.
- The large preponderance of attorneys/firms are facing dire financial difficulties, including the Legal Aid Board, to financially support this community to pursue restorative social justice in court.
- It has been almost a year that I have been pursuing the community case pro bono at the Land Claims court, purely from my own meager and non-existent financial resources.
Request for donations:
- Many community members have passed away during the intervening period [prior to December 31, 1998, to date] without their dignity being affirmed and restored.
- On behalf of the community, donations are humbly requested to pursue restorative social justice and affirmed human rights as enshrined in chapter two of the Constitution Act 108 of 1996 for the following:
- Miscellaneous expenses: (i) Printer paper, cartridges (office stationery). (ii) Transport for court appearances and community engagements. (iii) Petrol/toll fees. (iv) Hotel accommodation.
